Conditions of Business for Artist Services

1. Scope and Application

These Conditions of Business apply to all professional artist services provided by Chrissy Moore Art Advisory (“CMAA”). By engaging CMAA for any service—whether on a commission, fixed fee, or project basis—the artist (“the Artist”) agrees to be bound by these terms.

Services offered by CMAA include, but are not limited to:

  • Exhibition Planning & Curation

  • Art Fair Participation

  • Introductions to Curators & Collectors

  • Mentorship Programme

  • Funding Opportunity Alerts

  • Career Planning Consultations

  • Portfolio Review & Development

  • CV and Artist Statement Refinement

  • Public Relations and Press Kits

  • Grant Application Support

  • Residency Application Coaching

  • Artist Community Engagement

  • Workshops and Peer Learning Events

  • Light-Touch Consults & Planning Support

2. Commission Terms

CMAA will earn a commission for services where outcomes are tied to the sale of artwork, such as direct sales facilitation or platform-driven representation.

Commission rates are typically 40% of the artwork’s gross or net sale price and are agreed upon in writing prior to the engagement.

Commission is payable when CMAA facilitates the sale or directly contributes to a transaction, with payment due upon full receipt from the buyer.

3. Fixed Fee and Project-Based Services

Services not directly linked to sales—such as exhibitions, mentorship, advisory consultations, or application support—are billed on a fixed fee or per-project basis.

Fees will be communicated clearly in advance, with deliverables, milestones, and timelines agreed in writing before work commences.

Payment terms for fixed fee services typically require a 50% deposit upon commencement, with the balance due upon completion unless otherwise agreed.

4. Artist Responsibilities

The Artist agrees to provide timely and accurate materials required for the delivery of services. This may include:

  • High-resolution artwork images

  • Artwork details (titles, medium, dimensions, year)

  • Artist biography, CV, and statement

  • Access to prior pricing or exhibition history (where relevant)

The Artist confirms full legal ownership of artworks to be promoted or sold and the right to enter into agreements with CMAA.

The Artist agrees to respect any exclusivity periods or representation terms as documented in the individual service agreement.

5. CMAA Responsibilities

CMAA agrees to act with integrity, care, and professionalism in all engagements.

CMAA retains discretion over the execution of services, including curation, marketing, and network engagement, while consulting the Artist as needed.

CMAA is not liable for unsold works, grant or residency outcomes, or exposure results beyond the professional effort agreed.

6. Payments, Sales, and Logistics

For sales-based services, CMAA may invoice the buyer, receive payment, and remit net proceeds to the Artist after commission deduction within 30 days.

For all other services, invoices will be issued directly to the Artist per the agreed fee schedule.

Any third-party costs (e.g., shipping, insurance, fabrication) must be pre-approved by the Artist and may be invoiced separately.

7. VAT and Taxes

Unless otherwise stated, all fees, commissions, and service charges quoted by CMAA are exclusive of Value Added Tax (VAT).

Where applicable, VAT will be added at the prevailing rate and clearly itemised on invoices.

The Artist is responsible for any local taxes, withholding obligations, or duties applicable to payments made under this agreement, unless otherwise agreed in writing.

If the Artist is based outside the UK and VAT is not chargeable (e.g., under reverse charge or exemption rules), CMAA may request supporting documentation for compliance purposes.

8. Confidentiality and Data

Both CMAA and the Artist agree to maintain confidentiality regarding any financial, strategic, or personal information shared during the course of engagement.

CMAA adheres to applicable data protection regulations in storing and processing artist information.

9. Termination

Either party may terminate an engagement by providing 14 days’ written notice, subject to completion of outstanding deliverables and payment of any fees due.

Immediate termination may occur in cases of misconduct, breach of contract, or misrepresentation.

10. Governing Law and Dispute Resolution

These Conditions are governed by and construed in accordance with the laws of Scotland.

Any disputes arising out of or in connection with these Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

11. Anti-Money Laundering Compliance and KYC

In accordance with the UK’s implementation of the Fifth Anti-Money Laundering Directive (5AMLD), Chrissy Moore Art Advisory (“CMAA”) is required to undertake Know Your Customer (KYC) checks on all artists with whom we work.

All artists engaging CMAA for services agree to cooperate with these checks by providing specific information and documentation, which may include:

  • A valid photo identification document (such as passport or driver’s license)

  • Residential address and proof thereof (such as utility bill or bank statement)

  • Date of Birth

  • Gender

  • Nationality

CMAA will store this information securely and process it solely for the purposes of regulatory compliance and due diligence. Failure to provide the required information may delay the start of services or result in the termination of the engagement.
